Former President Trump Asks Supreme Court Permission for National Guard Troop Deployment in Illinois

On Friday, the government submitted an urgent appeal to the federal top court, seeking clearance to deploy state guard forces to Chicago and surrounding areas.

This move is part of a wider push to widen the domestic use of the armed forces in multiple cities run by Democrats.

Legal Battle Over Guard Activation

In an urgent petition, the federal legal authorities asked the bench to reverse a earlier court order that had blocked the deployment of hundreds of national guard troops to the greater Chicago.

The federal judge had voiced concerns about the White House's explanation for activating the guard, challenging its explanation in light of the situation on the ground.

A federal appeals court upheld the initial ruling on midweek, maintaining the deployment on pause while the legal challenge moves forward.

Administration's Claims

The top government lawyer, speaking on behalf of the White House, stated in the new filing that government officers have repeatedly been “intimidated and targeted” in downtown Chicago and the outlying area of Broadview.

This area is home to an Immigration and Customs Enforcement detention facility.

The former president has already dispatched military reserve units to the Windy City and Portland, after previous sendings to Los Angeles, Memphis, Tennessee, and Washington, District of Columbia.

The president has claimed that troop deployment is required to reduce protests and bolster immigration enforcement.

Ideological Opposition

Democratic officials have strongly opposed the decision, saying that the president’s claims are overstated and partisan in nature.

They allege the president of misusing his executive power to retaliate against critics.

Judges have also expressed doubt about the government's portrayal of ongoing incidents.

Local leaders say that protests over deportation policies have been primarily small and non-violent, challenging the administration's portrayal of “combat area” circumstances.

Legal Basis

At the heart of the legal battle is the government's invocation of a US code authorizing the president to federalize the state guard only in instances of insurrection or when “incapable with the regular forces to carry out the statutes of the nation”.

The government maintains that the troops are required to safeguard government buildings and personnel from activists.

Latest Developments

Earlier this month, the White House federalized three hundred troops of the Illinois military reserve and ordered additional guard from Texas forces into the Illinois.

As city officials criticized the move, the former president escalated his rhetoric, calling on the detention of the city's leader and the Illinois governor, each a Democrat, charging them of not managing to protect ICE personnel.

State authorities and the city of Chicago together took legal action against the White House to block the deployment.

On the ninth of October, Judge April Perry, a Biden appointee, issued a preliminary order stopping the order.
